What is the Foreclosure Process in Florida?

Foreclosure in Florida is the judicial process by which a lender obtains satisfaction of the debt owed by the homeowner by filing a complaint in circuit court, asking the court for a judgment of foreclosure and to schedule a judicial sale at public auction to the highest bidder.  If there is no other bidder, the property is acquired by the lender. If the defendant-homeowner does not respond to the initial summons and complaint within 20 days of being personally served with a copy, the clerk of court may find the defendant-homeowner in default, and the lender can ask the court to make a final ruling without further action.  If a response is filed within the 20 days, the defendant-homeowner may assert any available defenses and a hearing will be held to determine whether the lender is entitled to a judgment of foreclosure and judicial sale of the property. 
If the court rules against the defendant-homeowner at the hearing, the ruling will include the total amount owed to the lender and the foreclosure sale date. The foreclosure sale date is typically 20-35 days after the court ruling, but this may vary depending on the individual court or whether your attorney was able to negotiate a later sale date with the lender’s attorney.  Within 10 days of the foreclosure sale, the clerk transfers ownership to the winning bidder. In most instances, a borrower has no right of redemption after the certificate of sale is issued in a foreclosure auction.
